Transfer of Vehicle Ownership

Transfer Your Vehicle’s Ownership Easily with Friends RTO Consultants

Buying or selling a used vehicle? By law, you must transfer ownership with the RTO to reflect the new owner’s name on the RC (Registration Certificate). Friends RTO Consultants ensures a smooth, legally compliant ownership transfer process without the usual paperwork hassles, whether you’re an individual, a dealer, or a corporate fleet manager.

What is Vehicle Ownership Transfer?

Transfer of Vehicle Ownership refers to the legal process of updating the vehicle’s Registration Certificate (RC) to reflect the new owner’s name. This ensures that the new owner is officially responsible for the vehicle, including its taxes, insurance, traffic challans, and legal liabilities.

Who Needs to Transfer Ownership?

Ownership transfer is required when:

  • You sell your vehicle (bike, car, commercial vehicle) to another person or business
  • A vehicle owner passes away, and the legal heir needs to claim the vehicle
  • You’re buying a repossessed vehicle through a loan agency or government auction
  • You are transferring ownership within family or corporate structures

Important: Failing to transfer ownership can result in the previous owner being held liable for accidents, penalties, or unpaid dues related to the vehicle.

Step-by-Step Process for Ownership Transfer

The steps vary slightly depending on the reason for the transfer (sale, death, auction), but here is the general process:

  1. Sale Agreement & Initial Document Collection
    – Prepare a sale agreement, collect ID proofs of buyer and seller.
  2. Form Submission
    – Fill and submit Form 29 and Form 30 at the current RTO.
  3. Address & ID Verification
    – RTO verifies documents, identity, and address of both parties.
  4. Road Tax & Challan Check
    – Clearance for any outstanding dues or challans.
  5. NOC (if Inter-RTO Transfer)
    – NOC may be required if transferring to another RTO or state.
  6. Fee Payment & Acknowledgment
    – Pay applicable fees; receive receipt.
  7. RC Update & Delivery
    – RTO issues a new RC in the buyer’s name, physically or digitally.

Important Points to Consider

  • Ownership transfer must be completed within 30 days of sale to avoid penalties.
  • Ensure that the insurance is also updated to the new owner’s name.

  • If the vehicle is under loan, hypothecation must be terminated before or along with the transfer.

FAQs

When is it mandatory to transfer vehicle ownership?

Ownership transfer is mandatory in the following cases:
- Sale of a vehicle to another person
- Purchase of a used vehicle
- Transfer due to death of the registered owner (succession)
- Auction purchase of a vehicle
- Vehicle gifted to a family member or friend

Can I sell my vehicle without transferring ownership?

Technically, you can sell the vehicle, but until the ownership is transferred, you remain legally responsible for the vehicle. This includes fines, taxes, accidents, or legal issues related to the vehicle.

How long does the vehicle ownership transfer process take?

It typically takes 7 to 21 working days, depending on the RTO’s processing speed and completeness of the documentation.

Is vehicle ownership transfer possible online?

In some states, partial online submission is available through Parivahan Sewa, but physical document submission and RTO verification are usually still required. Friends RTO Consultancy handles both online and offline processes for your convenience.

Can vehicle ownership be transferred to another state?

Yes, but you first need to obtain a NOC (No Objection Certificate) from the current RTO before transferring ownership to another state's RTO. We assist with both NOC and re-registration.

What happens if I don’t transfer ownership after buying a vehicle?

If ownership isn’t legally transferred, the seller will still be liable for any accidents, legal violations, or fines related to the vehicle. It may also cause problems during resale or insurance claims.
